Your Tenant Rights Explained
Right to a Habitable Home
In virtually every jurisdiction, landlords are legally required to provide housing that is safe, clean, and livable. This means working heat, hot water, no pest infestations, and a weatherproof structure. If your landlord fails to maintain habitability, you may have the right to withhold rent or terminate the lease — but always check local laws first.
Right to Privacy
Your landlord generally cannot enter your home without proper notice. In most US states, 24–48 hours notice is required for non-emergency inspections or repairs. Emergency access (for example, a burst pipe) is different — but a landlord who shows up unannounced routinely may be violating your rights.
Right to Your Security Deposit
Your deposit belongs to you until there is a specific, documented reason for a deduction. Normal wear and tear — small nail holes, minor carpet wear — is typically not a valid reason to withhold a deposit. Landlords must provide an itemized breakdown of any deductions, and failure to return the deposit on time can result in penalties.
Right to a Written Lease
Never rent without a written lease. A verbal agreement offers very little protection. Your lease should clearly state: rent amount and due date, deposit amount and conditions, lease term, notice required to vacate, and policies on guests, pets, and alterations.
Right to Non-Discrimination
Under the Fair Housing Act in the US, landlords cannot discriminate based on race, color, national origin, religion, sex, familial status, or disability. Many states extend these protections further to include source of income, sexual orientation, or immigration status.
Building Your Record
One of the best ways to protect your rights as a tenant is to have a documented, verified rental history. When landlords know that tenants keep verified records — and that those records reflect on the landlord publicly — they're more likely to behave professionally from day one. That's exactly what RentTrust is built to do.
